Terms of Use
1. Purpose and acceptance
These terms of use (the “Terms”) govern access to and use of the Up mobile app (the “App”) and the startwithup.com website (the “Site”), together the “Service”.
By downloading, installing or using the App, you accept these Terms and the Privacy Policy without reservation. If you do not accept these terms, do not use the App.
2. Publisher
The Service is published by the publisher identified in the legal notice (the “Publisher”, “we”).

3. Access to the app
- The App is distributed on Apple’s App Store and runs on iPhone with iOS 26.1 or later. Some features depend on system permissions that you must grant (alarms, Screen Time, notifications, motion).
- Downloading is free. Some features are reserved for the Up Pro subscription (section 5).
- The App works without an account. You may optionally link an email address to get your settings back on another device; in doing so, you warrant that the address belongs to you.
- You are responsible for your device, its network connection, and the confidentiality of the sign-in codes you receive by email.
- You must be at least 15 years old, or have the consent of a parent or legal guardian, to use the Service.
4. Description of the service
Up is a self-discipline tool that helps you build and protect a morning routine. It includes in particular:
- an anti-snooze alarm, which rings like a system alarm and may require a physical action (getting up and walking) to be stopped;
- app blocks, which restrict access to apps you choose, during time windows you define, through Apple’s Screen Time feature;
- timed focus sessions;
- tracking of your progress (wake-ups kept, blocks respected, streaks).
Up is a personal commitment tool: you set the constraints yourself, and you can change or remove them. Up is neither a parental control device nor a medical device, and provides no medical or sleep-related advice.
Alarm reliability. Despite all the care taken, an alarm may fail to ring in certain circumstances beyond the App’s control: device switched off or out of battery, system settings (Focus mode, notification restrictions, uninstalling or updating the App), iOS malfunction. Do not rely on Up as your only alarm for an important event.
App blocking. Blocking relies on the Screen Time permissions granted to the App. It can be bypassed or disabled by the device holder, and its operation depends on Apple.
5. Up Pro subscription
5.1 Content and price
Up Pro gives access to all of the App’s features. The available plans (for example monthly or yearly), their price including all taxes in your local currency, and any free trial period are displayed in the App before any purchase.
5.2 Purchase through Apple
The subscription is purchased and billed by Apple through your Apple Account (in-app purchase). Apple’s terms of sale (Apple Media Services) apply to payment, billing and refunds. We neither receive nor store your payment details.
5.3 Trial period
When a free trial period is offered, it automatically converts into a paid subscription when it ends, unless canceled at least 24 hours before the end of the trial. A trial is granted only once per Apple Account.
5.4 Automatic renewal
The subscription renews automatically, for the same period and at the same price, unless canceled at least 24 hours before the end of the current period. The renewal amount is charged to your Apple Account within the 24 hours before the end of the period.
5.5 Managing and canceling
You can manage or cancel your subscription at any time from your iPhone settings: Settings › [your name] › Subscriptions. Cancellation takes effect at the end of the period already paid for; no pro-rata refund is made for the current period. Deleting the App does not cancel the subscription.
5.6 Restoring purchases
An active subscription can be restored on a new device signed in to the same Apple Account via “Restore Purchases” in the App.
5.7 Price changes
We may change subscription prices. Any price change is notified to you in advance by Apple and only applies from your next renewal, under the conditions set by Apple; you remain free to cancel before it takes effect.
6. Right of withdrawal
Purchases made through the App Store are subject to Apple’s terms, which give consumers in the European Union a 14-day right of withdrawal from the date of purchase, to be exercised directly with Apple (reportaproblem.apple.com). Any refund request is handled by Apple under its own terms.
7. Acceptable use
You agree to use the Service in compliance with the law and these Terms. In particular, you must not:
- decompile, disassemble, modify or attempt to extract the source code of the App, except to the extent permitted by law;
- circumvent or tamper with the App’s technical measures or subscription mechanisms;
- access the Service by automated means or disrupt its operation;
- use the Service to infringe the rights of third parties or for fraudulent purposes;
- submit, through the support or suggestion features, content that is unlawful, abusive or harmful to third parties.
8. Intellectual property
The App, the Site, their code, design, text, alarm sounds, illustrations, and the “Up” brand and logo are the property of the Publisher or its licensors and are protected by intellectual property law.
The Publisher grants you a personal, non-exclusive, non-transferable and revocable license to use the App on Apple devices that you own or control, under these Terms and the App Store usage rules. Any other use is prohibited without prior written permission.
Suggestions and feedback you send us may be freely used to improve the Service, without obligation or compensation.
9. Personal data
The processing of your data is described in the Privacy Policy, which forms an integral part of these Terms.
10. Updates, availability and changes to the service
- The App evolves: we may add, change or remove features, and release updates that you are invited to install to keep benefiting from the Service.
- We strive to keep the Service available at all times, but cannot guarantee it. The Service may be interrupted for maintenance, in the event of an incident, or due to a failure of a provider or of Apple.
- We may stop supporting certain iOS versions or, eventually, discontinue the Service, with reasonable notice given in the App or on the Site. In that case, no renewal will be charged beyond the discontinuation date.
11. Liability
The Service is provided “as is”, to the extent permitted by law. Up is a personal organization aid: we guarantee no outcome (waking up, productivity, reduced screen time) and provide no medical advice.
To the extent permitted by law, the Publisher cannot be held liable for indirect damages, nor for the consequences of an alarm that failed to ring, a block that did not work, unavailability of the Service, or a malfunction attributable to your device, iOS, Apple or a third party.
Nothing in these Terms limits the rights granted to you by mandatory consumer protection legislation, nor the Publisher’s liability in the event of gross negligence or willful misconduct, or of personal injury.
12. Termination
You can stop using the Service at any time by uninstalling the App and, where applicable, deleting your account from Profile › Account › Delete account (which does not cancel an ongoing subscription, see section 5.5).
In the event of a serious or repeated breach of these Terms, the Publisher may suspend or terminate your access to the Service, with notice where possible.
13. Apple-specific provisions
The App is distributed through the App Store. The following provisions apply in addition:
- These Terms are entered into between you and the Publisher only, not with Apple. The Publisher is solely responsible for the App and its content.
- The license granted is limited to use of the App on Apple-branded products that you own or control, in accordance with the usage rules set out in the Apple Media Services terms.
- Apple has no obligation to provide any maintenance or support services for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price where applicable; to the extent permitted by law, Apple will have no other warranty obligation.
- The Publisher, not Apple, is responsible for addressing any claims relating to the App (product liability, failure to conform to a legal requirement, consumer protection, etc.).
- In the event of a third-party claim that the App infringes its intellectual property rights, the Publisher, not Apple, will be responsible for the investigation, defense and settlement of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any list of restricted or prohibited parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce them against you.
- You must comply with the applicable terms of any third-party services used with the App.
14. Changes to the Terms
We may change these Terms, in particular to reflect changes to the Service or to regulations. The version in force is the one published on the Site, with its update date. In the event of a substantial change, we will let you know in the App; continuing to use the Service after the new Terms take effect constitutes acceptance.
15. Governing law and disputes
These Terms are governed by French law, without prejudice to more favorable mandatory provisions of the country of residence of consumers in the European Union.
If you run into a problem, contact us first at contact@startwithup.com: most issues are easily resolved. In accordance with articles L.611-1 et seq. of the French Consumer Code, you may also use a consumer mediator free of charge for any unresolved dispute; the contact details of the competent mediator will be provided on request at the same address. Failing an amicable resolution, the matter may be brought before the competent French courts.
